Reid's future uncertain after Eagles' finish

EAST RUTHERFORD, N.J. (AP) ? Andy Reid sounded like a man who knows he's going to lose his job.

Eli Manning threw a career-best five touchdown passes and the New York Giants routed Philadelphia 42-7 on Sunday in what likely was Reid's final game coaching the Eagles.

"We weren't very good," Reid said. "That's my responsibility and I take complete blame for it."

The Eagles (4-12) lost 11 of their final 12 games after a promising 3-1 start and missed the playoffs for the second straight year for the first time in Reid's 14 seasons. It was their worst record under Reid.

Asked if he wants to return in 2013, Reid said: "I'm all in."

Reid expects to meet with owner Jeffrey Lurie on Monday.

"I go in eyes wide open," Reid said. "Either way, I understand. Whatever he chooses will be the right thing. He always does things for the best interests of the Eagles."

Reid won more games (140) than any coach in franchise history. He led the Eagles to nine playoff appearances, six division titles, five NFC championship games and one Super Bowl loss.

But he couldn't win the big one and that's how he's measured in a city that hasn't celebrated an NFL title since 1960.

The Eagles haven't won a playoff game since 2008 and took significant steps backward the last two years. They entered both seasons with high expectations only to fail miserably.

"We had quite a run," offensive coordinator Marty Mornhinweg said.

Players said they expect changes, but continued to support Reid.

"He's a great man and I love him to death," said quarterback Michael Vick, who could've played his last game with the Eagles. "I wish I could've done more. A lot of players wish they could've done more. Coaches can't play the games."

An ugly loss to the Giants (9-7) was a fitting end to a terrible season for the Eagles, who began the year with Super Bowl aspirations.

Tight end Brent Celek called it "embarrassing." Defensive tackle Cullen Jenkins questioned his teammates' effort. So did Vick before trying to clarify his comment.

"We came, we stunk it up and we lost. It was terrible. No heart," Jenkins said.

Added Vick: "Sometimes I wish I can play other positions."

Vick was 19 of 35 for 197 yards, one TD and one interception in his first game since Nov. 11. He missed the previous six games, sitting out the first five with a concussion and then being inactive last week. Vick only got the start because rookie Nick Foles broke his hand.

Vick is due to earn about $16 million next year, but the Eagles can release him without taking a financial hit. He wants to be a starter and is unsure whether he even wants to come back.

"I don't know. I have to take time to think about everything that's happened," Vick said.

The Eagles talked all week about wanting to win one for Reid. They should've stayed on the team bus instead.

After opening the game with an onside kick and recovering, it was all downhill for Philadelphia.

That first drive ended when Vick was intercepted by Stevie Brown, who returned the pick 48 yards to the Eagles 26. A few plays later, Manning hit Rueben Randle on a 3-yard TD pass for a 7-0 lead.

Manning then connected with Randle on a 38-yard TD pass over Nnamdi Asomugha to make it 14-0. He tossed a 15-yard TD pass to David Wilson for a 21-0 lead.

The Eagles finally got going early in the second quarter. Vick threw a 15-yard pass to Jason Avant on fourth-and-10 and hit Jeremy Maclin on a 7-yard pass for a TD on fourth-and-1.

But the defense couldn't stop the Giants. After a pass interference penalty on Asomugha in the end zone, Ahmad Bradshaw ran in from the 1 to make it 28-7.

Right before the half, Manning connected with a wide-open Victor Cruz for a 24-yard TD to make it 35-7.

Manning's fifth TD pass was a 1-yard toss to Henry Hynoski.

"If it's an effort deal, shame on them," Celek said about players who didn't give their all.

Despite the lopsided win, the Giants are also going home.

The defending Super Bowl champions were eliminated from playoff contention when Chicago beat Detroit 26-24. It marks the seventh straight season the Super Bowl champion has failed to win a playoff game the following year.

Manning finished 13 of 21 for 208 yards and no interceptions. Bradshaw rushed for 107 yards and passed the 1,000-yard rushing mark for the second time in his career.

NOTES: Reid has one year left on his contract for about $6 million. ... The Eagles allowed 25 touchdowns passing and had only one interception in the final 10 games after Todd Bowles replaced Juan Castillo as defensive coordinator. ... The Eagles missed the playoffs four of the last eight years after going to the 2005 Super Bowl.

China Wary as Japan's New PM Hails Security Alliance With U.S.

(CNSNews.com) ? Closely watched by a wary China, Shinzo Abe?s return to the Japanese premiership gives him a second chance to pursue changes to Japan?s defense policies aimed at making it a more effective ally of the United States in a crucial region.

During Abe?s truncated earlier term as prime minister, his key security policy initiatives included making constitutional revisions to enable Japan to exercise its right to collective self-defense, and establishing a national security council.

Neither survived his September 2007 resignation, but Abe told his first press conference after taking the helm this week they were both back on the agenda.

He also described Japan?s alliance with the U.S. as ?the cornerstone of Japanese diplomacy,? saying that strengthening bilateral ties was ?the first step in turning Japan?s foreign and security policy around.?

Abe, who claims the alliance suffered during three years under the center-left Democratic Party of Japan, says he hopes to visit Washington as early as next month.

?More than anything else, it is imperative that we rebuild the relationship of trust we enjoy under the Japan-U.S. alliance.?

Abe also announced the creation of a new cabinet portfolio ? a minister in charge of reinforcing national security ? while an envisaged national security council would serve as a ?control tower.?

Under current interpretations of the war-renouncing constitution, drafted by U.S. military lawyers after Imperial Japan?s defeat in 1945, Japan cannot exercise its right to come to the defense of an ally under attack.

Although the two countries signed a Treaty of Mutual Cooperation and Security in 1960, Japan?s ability to respond to an armed attack against the U.S. in the region is constrained by its constitution.

(Article five of the treaty states: ?Each Party recognizes that an armed attack against either Party in the territories under the administration of Japan would be dangerous to its own peace and safety and declares that it would act to meet the common danger in accordance with its constitutional provisions and processes.?)

The U.S. deploys some 50,000 troops in Japan.

In a neighborhood where crises could potentially erupt on the Korean peninsula or in the Taiwan Strait, or be sparked by various territorial disputes between an increasingly-assertive China and other countries in the region including their own, many Japanese conservatives have wanted to remove the constitutional restrictions, regarding them as a curb on the ability of the world?s third-largest economy to play a bigger role on the regional and international stage.

During his earlier term Abe set up an expert panel to investigate collective self-defense options. Now the prime minister ? only the second Japanese politician to make such a comeback since World War II ? has a rare opportunity to pick up on the issue.

?Aggravating tensions?

The return of a conservative government in Japan comes at a time when the Obama administration has been pursuing a ?pivot? to Asia. Outgoing Secretary of State Hillary Clinton has said the region will be the ?the world?s strategic and economic center of gravity? this century and has worked to strengthen relationships across the region.

Beijing regards the ?pivot? as an attempt by the U.S. to counterbalance its rise, and Abe?s declared emphasis on the alliance with Washington will fuel that view.

?China hopes Japan takes a peaceful development path and plays a constructive role in regional peace,? Chinese foreign ministry spokeswoman Hua Chunying told a press briefing Wednesday.

Less diplomatic was an editorial Thursday in the Communist Party-affiliated Global Times, which said it was unrealistic to expect relations with Japan to improve.

?Tension has existed in the Sino-Japanese relationship for more than a decade,? it said. ?Given that the situation in the Asia-Pacific hasn?t improved, the relationship of the two countries cannot really become warmer.?

The paper said there was a possibility that Japan could ?become an anti-China country even more radical than the U.S.,? but said ultimately the main concern for China was the U.S., rather than Japan.

In its editorial take on the new Japanese government, the state-run China Daily said that if Abe follows the policies he outlined while campaigning he will ?only aggravate the tension? already existing over disputed islands in the East China Sea.

It noted that Abe had told President Obama shortly before the election that the security environment in East Asia was ?severe? because of China?s growing ?assertiveness,? but said he had failed to mention that Japan?s actions were responsible for the bilateral tensions.

?Japan must be reminded that its intention to use its alliance with the US as pressure to deter China or stabilize the bilateral relations will not work,? China Daily said.

Meanwhile there is no sign that the simmering dispute over the islands, known as Senkaku in Japan and Diaoyu in China, will be resolved soon.

A spokesman for China?s State Oceanic Administration on Thursday accused Japan of escalating the dispute by deploying military aircraft to ?disturb? a Chinese marine surveillance plane patrolling airspace near the islands.

Chinese Defense Ministry spokesman Yang Yujun told a press briefing the military was being ?highly vigilant? about the Japanese activity and would ?safeguard China?s maritime law enforcement activities and protect the country?s territorial integrity and maritime rights.?

At his press conference Wednesday Abe said he was resolved to ?defend fully people?s lives, our territory and our beautiful ocean.?

Citing the Senkaku islands, he said ?the security of Japan is not someone else?s problem; it is a crisis that exists right there and now.?

Situated about halfway between the Chinese mainland and Japan?s southernmost island of Okinawa, the islands have been under disputed Japanese control since the late 19th century. The latest tensions erupted after the Japanese government earlier this year signed an agreement to buy three of the uninhabited islands from their owner, a businessman.

China declared the move illegal, complained to the United Nations and surveillance ships to waters around the islands, where Japanese coastguard vessels are also deployed.

Defense Secretary Leon Panetta warned last September that a ?misjudgment? by either side could trigger a clash that could escalate into war.

Any such conflict would directly impact the United States: While saying it does not back either country?s claim to the islands, the U.S. has since 2004 made clear that it regards the islands as falling within the scope of article five of the Treaty of Mutual Cooperation and Security.

On your computer Evernote can copy selected windows on the screen, including web pages if your browser supports it. You can then mark these copies with titles and organize them into notebook, archiving them in a number of ways.

On mobile devices, items you?ve copied can be synced directly to the Evernote cloud service, so you?ll never lose any of the information that you?re organizing. You can also take pictures from your smartphone or tablet and save them directly onto your Evernote account. You can also add GPS tagging and audio comments to each of the pictures you save.

There are hundreds of ways you can use this tool to your advantage. Many companies have switched to Evernote as their central filing system, abandoning physical paperwork altogether. Students use it as a great way to take written notes and keep track of their school work. Families use it as a cheap way to store their photos through a cloud service, versus an unsecure hard drive.

Pomodoro Technique

Developed back in the late 1980s, the Pomodoro technique is an incredible time management system that involves working in short focused waves. This takes a lot of pressure off a particular task while discouraging unnecessary multitasking.

Steps:

  • Select a take you need to accomplish today.
  • Set a timer for 25 minutes and begin working on that task.

Every 4 cycles, take a 25 minute break.

Strike likely averted at East Coast ports

(AP) ? The union for longshoremen along the East Coast and Gulf of Mexico has agreed to extend its contract for 30 days, averting a possible strike that could have crippled operations at ports that handle about 40 percent of all U.S. container cargo, a federal mediator announced Friday.

The extension came after the union and an alliance of port operators and shipping lines resolved one of the stickier points in their months-long contract negotiations, involving royalty payments to the longshoremen for each container they unload.

Negotiations will continue until at least midnight Jan. 28. Some important contract issues remain to be resolved, but the head of the Federal Mediation and Conciliation Service, George Cohen, said the agreement on royalties was "a major positive step forward."

"While some significant issues remain in contention, I am cautiously optimistic that they can be resolved in the upcoming 30-day extension period," he said.

The terms of the royalty agreement were not announced.

The master contract between the International Longshoremen's Association and the U.S. Maritime Alliance originally expired in September. The two sides agreed to extend it once before, for 90 days, but it had been set to expire again at 12:01 a.m. Sunday.

As recently as Dec. 19, the president of the longshoremen, Harold Daggett, had said a strike was expected.

A work stoppage would have idled shipments of a vast number of consumer products, from electronics to clothing, and kept U.S. manufacturers from getting parts and raw materials delivered easily.

Business groups expressed relief that the two sides had agreed to keep the ports open.

"A coast-wide port shutdown is not an option. It would have severe economic ramifications for the local, national and even global economies and wreak havoc on the supply chain," said National Retail Federation President Matthew Shay.

Major ports that would have been frozen included the massive terminals serving New York City overseen by the Port Authority of New York and New Jersey, and critical seaports in Savannah, Ga., Houston, and Hampton Roads, Va.

New York Shipping Association President Joseph Curto said avoiding a strike is critical "to thousands of workers who depend on port activities for their livelihood."

Other ports that would have been affected by a strike are in Boston; the Philadelphia area; Baltimore; Wilmington, N.C.; Charleston, S.C.; Jacksonville, Fla.; Port Everglades, Fla.; Miami; Tampa, Fla.; Mobile, Ala.; and New Orleans.

Longshoremen on the West Coast have a separate collective bargaining agreement.

Wall St Week Ahead - Cliff may be a fear, but debt ceiling much scarier

REUTERS - Investors fearing a stock market plunge - if the United States tumbles off the "fiscal cliff" next week - may want to relax.

But they should be scared if a few weeks later, Washington fails to reach a deal to increase the nation's debt ceiling because that raises the threat of a default, another credit downgrade and a panic in the financial markets.

Market strategists say that while falling off the cliff for any lengthy period - which would lead to automatic tax hikes and stiff cuts in government spending - would badly hurt both consumer and business confidence, it would take some time for the U.S. economy to slide into recession. In the meantime, there would be plenty of chances for lawmakers to make amends by reversing some of the effects.

That has been reflected in a U.S. stock market that has still not shown signs of melting down. Instead, it has drifted lower and become more volatile.

In some ways, that has let Washington off the hook. In the past, a plunge in stock prices forced the hand of Congress, such as in the middle of the financial crisis in 2008.

"If this thing continues for a bit longer and the result is you get a U.S. debt downgrade ... the risk is not that you lose two-and-a-half percent, the risk is that you lose ten and a half," said Jonathan Golub, chief U.S. equity strategist at UBS Equity Research, in New York.

U.S. Treasury Secretary Tim Geithner said this week that the United States will technically reach its debt limit at the end of the year.

INVESTORS WARY OF JANUARY

The White House has said it will not negotiate the debt ceiling as in 2011, when the fight over what was once a procedural matter preceded the first-ever downgrade of the U.S. credit rating. But it may be forced into such a battle again. A repeat of that war is most worrisome for markets.

Markets posted several days of sharp losses in the period surrounding the debt ceiling fight in 2011. Even after a bill to increase the ceiling passed, stocks plunged in what was seen as a vote of "no confidence" in Washington's ability to function, considering how close lawmakers came to a default.

Credit ratings agency Standard & Poor's lowered the U.S. sovereign rating to double-A-plus, citing Washington's legislative problems as one reason for the downgrade from triple-A status. The benchmark S&P 500 dropped 16 percent in a four-week period ending August 21, 2011.

"I think there will be a tremendous fight between Democrats and Republicans about the debt ceiling," said Jon Najarian, a co-founder of online brokerage TradeMonster.com, in Chicago.

"I think that is the biggest risk to the downside in January for the market and the U.S. economy."

There are some signs in the options market that investors are starting to eye the January period with more wariness. The CBOE Volatility Index <.vix>, or the VIX, the market's preferred indicator of anxiety, has remained at relatively low levels throughout this process, though on Thursday it edged above 20 for the first time since July.

More notable is the action in VIX futures markets, which shows a sharper increase in expected volatility in January than in later-dated contracts. January VIX futures are up nearly 23 percent in the last seven trading days, compared with a 13 percent increase in March futures and an 8 percent increase in May futures. That's a sign of increasing near-term worry among market participants.

The CBOE Volatility Index closed on Friday at 22.72, gaining nearly 17 percent to end at its highest level since June as details emerged of a meeting on Friday afternoon of President Barack Obama with Senate and House leaders from both parties where the president offered proposals similar to those already rejected by Republicans. Stocks slid in late trading and equity futures continued that slide after cash markets closed.

"I was stunned Obama didn't have another plan, and that's absolutely why we sold off," said Mike Shea, a managing partner and trader at Direct Access Partners LLC, in New York.

Obama offered hope for a last-minute agreement to avoid the fiscal cliff after a meeting with congressional leaders, although he scolded Congress for leaving the problem unresolved until the 11th hour.

"The hour for immediate action is here," he told reporters at a White House briefing. "I'm modestly optimistic that an agreement can be achieved."

The U.S. House of Representatives is set to convene on Sunday and continue working through the New Year's Day holiday. Obama has proposed maintaining current tax rates for all but the highest earners.

Consumers don't appear at all traumatized by the fiscal cliff talks, as yet. Helping to bolster consumer confidence has been a continued recovery in the housing market and growth in the labor market, albeit slow.

The latest take on employment will be out next Friday, when the U.S. Labor Department's non-farm payrolls report is expected to show jobs growth of 145,000 for December, in line with recent growth.

Consumers will see their paychecks affected if lawmakers cannot broker a deal and tax rates rise, but the effect on spending is likely to be gradual.

PLAYING DEFENSE

Options strategists have noted an increase in positions to guard against weakness in defense stocks such as General Dynamics because those stocks would be affected by spending cuts set for that sector. Notably, though, the PHLX Defense Index is less than 1 percent away from an all-time high reached on December 20.

This underscores the view taken by most investors and strategists: One way or another, Washington will come to an agreement to offset some effects of the cliff. The result will not be entirely satisfying, but it will be enough to satisfy investors.

"Expectations are pretty low at this point, and yet the equity market hasn't reacted," said Carmine Grigoli, chief U.S. investment strategist at Mizuho Securities USA, in New York. "You're not going to see the markets react to anything with more than a 5 (percent) to 7 percent correction."

Save for a brief 3.6 percent drop in equity futures late on Thursday evening last week after House Speaker John Boehner had to cancel a scheduled vote on a tax-hike bill due to lack of Republican support, markets have not shown the same kind of volatility as in 2008 or 2011.

A gradual decline remains possible, Golub said, if business and consumer confidence continues to take a hit on the back of fiscal cliff worries. The Conference Board's measure of consumer confidence fell sharply in December, a drop blamed in part on the fiscal issues.

"If Congress came out and said that everything is off the table, yeah, that would be a short-term shock to the market, but that's not likely," said Richard Weiss, a Mountain View, California-based senior money manager at American Century Investments.

"Things will be resolved, just maybe not on a good time table. All else being equal, we see any further decline as a buying opportunity."

Microsoft added a cloud storage feature to the Xbox 360 in its fall 2011 dashboard update, but today an outage has taken it offline for the last several hours and counting. As noted by Joystiq, trying to access your cloud saves is resulting in a 0x807b0198 error for many, although other parts of XBL like streaming video services and multiplayer gaming profiles are unaffected. For the moment, we were able to copy/move some of our saves from the cloud cache on our hard drive (Settings --> storage --> cloud storage) to the normal hard drive section, and access them from there. To regift or not to regift: Is it ever OK?

Sometimes you just don't want it.

OK, I?ve done it. And quite frankly, I always feel guilty about regifting.

It?s not that I don?t appreciate the present. But sometimes you get something that you really don?t like or can?t use, and there?s no way to take it back to the store. You don?t want to offend the person who gave it to you and you don?t want to throw it away. So you pass it along to someone else who might appreciate it more.

Is this a resourceful way of dealing with an unwanted gift? Or is this rude and distasteful behavior?

The Wall Street Journal recently reported that regifting, ?once a social taboo, is gradually gaining in acceptance.? The Journal points to a nationwide consumer spending survey done by American Express last year. More than half the respondents (58 percent) said it was OK to regift sometimes and 79 percent believed regifting during the holidays is acceptable. Of the 2,000 people questioned, nearly a quarter admitted to regifting at least one present the previous holiday season.

But there?s more. A new paper, ?The Gift We Keep on Giving,? published by Psychological Science,?concludes that regifting is not as offensive to the original givers as regifters assume.

Researchers from Stanford, Harvard and the London Business School conducted five studies that examined both hypothetical scenarios and actual regifting among friends.

They found that gift recipients believed regifting was as bad as throwing the present in the garbage. Gift givers, on the other hand, were significantly more offended by trashing their presents. They?d be much happier if that gift were given to someone else.

What causes this split perception? ?

It appears to be linked to different views about entitlement. The authors concluded: ?Givers believed that the act of gift giving passed title to the gift on to receivers, so that receivers were free to decide what to do with the gift; in contrast, receivers believed that givers retained some say in how their gifts were used.?

Egypt's parliament convenes after charter passes

CAIRO (AP) ? Egypt's upper house of parliament has convened in its first session after the passing of the country's Islamist-backed constitution, the first action by a state institution in accordance with a document whose legitimacy is still contested by the opposition.

The Shura Council was swearing in 90 new members appointed by President Mohammed Morsi Wednesday. The charter, approved by 63.8 percent in a two-round referendum that ended Saturday, gives the traditionally toothless upper house full legislative powers until elections for a new lower house is called within two months.

The Islamist-dominated council is expected to draft a law regulating upcoming parliamentary elections. Other items on the agenda may include laws on protests and the media.

The opposition says the constitutional process was rushed and the referendum marked by widespread irregularities.

Hundreds more flights canceled as Christmas storm moves east

Tornadoes were reported across parts of the South, compounding what was already likely to be a travel nightmare. Jim Cantore of The Weather Channel reports.

More than 500 more flights were canceled across the U.S. on a snowy, blustery Christmas Day, many of them in Texas, where the Dallas and Houston areas were smacked with a rare coating of snow and ice Tuesday.

The travel website?flightaware.com?reported that?523 flights into or out of U.S. airports were scrubbed. Many were at the Dallas and Houston airports, which got rare Christmas snowfall.

With 8 to 15 inches of snow expected across northern Ohio on Wednesday, United Airlines canceled at least 60 percent of its flights at Cleveland Hopkins Airport beginning at noon Wednesday, NBC station WKYC of Cleveland reported.


Numerous traffic accidents also stalled motorists across Texas and Oklahoma as drivers slid and crashed in a mixture of wind, sleet and snow. Twenty-one cars and tractor-trailers crashed in a massive pileup on roads coated with freezing rain in Oklahoma City.

"You definitely have to worry about everyone while you're driving, especially out here," Dallas resident Jerdal Whitaker told NBC 5 of Dallas. "We're not used to the weather that comes, especially when it's ugly, so you definitely have to drive slow."

With temperatures expected to drop into the teens, little melting was expected overnight.

Christmas storms spread snow, tornadoes across US, snarling travel

The Midwest was also heavily hit. A blizzard was forecast to end up having dropped 10 to 15 inches of snow on parts of Indiana, where road crews began work last Friday on keeping roads as passable as possible.

"We're hoping to make it there in time before that weather hits," said James Mason, who was driving home Tuesday to Missouri with his wife and three children through Indiana.

"We don't want to get caught up in it. That is when accidents happen and people get stranded," he told?NBC station WTHR of Indianapolis?during a rest stop in Plainfield, Ind.

The heavy snow spread into Kentucky, where state officials urged people to stay at home and off the roads.

"Try to avoid travel from, say, 9 or 10 Tuesday night through about noon on Wednesday, simply because the conditions are going to be so brutal," said Keith Todd, a spokesman for the state Transportation Department. "If you do go out, you ?need to be prepared like you're going to the North Pole."

In Ohio, the Transportation Department planned to have more than over 100 snow plows on the streets by 4 a.m. Wednesday.

The storm is forecast to hit the Northeast sometime Wednesday evening, bringing a mix of heavy sleet, snow or heavy rain, depending on its track.?

Motorists were warned to expect whiteout conditions in falling and blowing snow overnight Wednesday in the Buffalo area, where some locations could get as much as 14 inches by late Thursday, NBC station WGRZ of Buffalo reported.

An unreasonable sense of reasonable.

Professor Orin Kerr?discusses the?Supreme Court of North Carolina?s recent?ruling?that an investigative traffic stop, prefaced on an officer?s reasonable but mistaken understanding of the law, may still be valid:

?Under?Whren v. United States, 517 U.S. 806 (1996), the police can pull over a car based on probable cause to believe a traffic violation has occurred. Any civil traffic violation counts: If you?re driving at 36mph in a 35 mph zone, you can be lawfully pulled over. But what if the officer pulls over a car based on his belief that a violation has occurred, and it turns out that the officer has the law wrong? That is, what if you?re not violating the law, and the officer mistakenly thinks you are? And here?s where it gets interesting: What if the officer?s mistake about the law is a reasonable one?

Lower courts are deeply divided on the question, and the Supreme Court of North Carolina just entered the fray with?State v. Heien, ruling by a vote of 4-3 that the Fourth Amendment permits an officer to execute a seizure based on a reasonable mistake of law. The facts of?Heien?are the best possible facts for the government in a case like this. An officer spotted a car with a broken rear right brake light. The officer pulled over the car, and the traffic stop eventually led to the discovery of drugs in the car. The defendant was convicted, and on appeal persuaded the North Carolina Court of Appeals to adopt a rather surprising interpretation of the traffic laws. According to?a long statutory analysis from the North Carolina Court of Appeals, interpreting several archaic sections of the traffic code, it was actually?legal?to have one broken brake light as long as the other brake light functioned properly. The state government saw the opportunity: It accepted this interpretation of the statutes, and it petitioned the North Carolina Supreme Court only on the Fourth Amendment question of whether the stop was constitutionally reasonable even though it turned out that the officer?s belief that a broken tail light was unlawful was not correct. That is, did pulling over the car with a broken tail light violate the Fourth Amendment?

A divided North Carolina Supreme Court ruled that the stop was constitutionally reasonable. The officer had a reasonable belief as to what the traffic laws meant, the majority reasoned, and he acted reasonably. Because the Fourth Amendment requires reasonableness, this is all the Fourth Amendment requires and the resulting stop was constitutional. The dissent agrees that the officer acted reasonably in a generic sense, but it argues that we would not want to systemically allow stops of people who are not breaking the law at all based on erroneous officer understandings of what the law is. The dissent also points out that this is like an exclusionary rule case in disguise: The majority?s reasoning is akin to saying that there is a good faith exception at the remedies stage, the kind of thinking that should not infuse the court?s reasoning at the initial stage of whether a constitutional violation occurred.? In deciding valid traffic stops may include situations wherein?an officer pulls over a car based on a reasonable but mistaken understanding of law, the court arguably

  1. supplies?incentives for officers to enforce erroneous understandings of law;
  2. discourages accurate instruction of law;
  3. further invites messy (and likely inequitable) adjudication of reasonableness; and
  4. invites guessing for all concerned.

The United States Court of Appeals for the Fourth Circuit does not appear to have ruled directly on the question, yet. However, the ruling predicts the question will come up?perhaps in an attempted forfeiture action.?For North Carolina law enforcement to get around the state constitution?s directive that forfeitures go to education, local law enforcement invite federal authorities to adopt and prosecute their forfeiture cases with?an understanding that up to 80% of the proceeds will be kicked back to the initial seizing agencies.

The lure of forfeiture proceeds is, of course, a powerful motivator to find violations?fictional and otherwise.

South Sudan must punish those who downed UN helicopter: Russia

MOSCOW (Reuters) - Russia called on South Sudan on Saturday to punish those responsible for shooting down a U.N. helicopter, killing its four Russian crew, and take steps to ensure such incidents do not happen again.

A Russian Foreign Ministry statement named the victims and said the "tragic occurrence" in the African nation on Friday underscored the need to provide security for U.N. peacekeeping missions.

"We call on the government of South Sudan to conduct a proper investigation of the incident, to punish those responsible and undertake all measures to guarantee nothing like this happens in the future," it said.

The Mi-8 helicopter owned by Russian air charter company Nizhnevartovskavia was working under a U.N. contract on a reconnaissance mission in an area where the SPLA, South Sudan's army, has been fighting rebels led by David Yau Yau, according to a U.N. source.

The SPLA first denied it had shot down the helicopter but later said it had mistaken it for a Sudanese plane supplying rebels, and expressed regret.

The Russian statement said that the downing "raises the issue of the provision of security of U.N. peacekeeping missions with new acuteness", and that host nations must take the issue extremely seriously.

Russian parliament passes anti-US adoption measure

MOSCOW (AP) ? The lower house of the Russian parliament on Friday overwhelmingly passed a bill that would ban adoption of Russian children by Americans, sending the controversial legislation a step closer to President Vladimir Putin's desk.

Putin hasn't said whether he will sign the measure into law if it passes its next stage of being approved by the upper house.

Some top government officials including the foreign minister and the education minister have spoken flatly against the bill, one part of a larger measure by angry lawmakers retaliating against a recently signed U.S. law that calls for sanctions against Russians deemed to be human rights violators.

It nonetheless received strong approval in Friday's third reading in the State Duma, passing by a vote of 420-7-1. The upper house, the Federation Council, is likely to consider the measure on Wednesday, vice-speaker Alexander Torshin was quoted as saying by the Interfax news agency.

Torshin said there is "serious basis for supposing the draft bill will be supported by the Federation Council."

Originally the bill was more or less a tit-for-tat response, providing for travel sanctions and the seizure of financial assets in Russia of Americans determined to have violated the rights of Russians.

But it was expanded to include the adoption measure and call for the banning of any organizations that are engaged in political activities if they receive funding from U.S. citizens or are determined to be a threat to Russia's interests. In addition, it calls for anyone with dual Russian-U.S. citizenship to be banned as members of political organizations.

The U.S. said the adoption law would needlessly stop hundreds of Russian children from finding families.

"The welfare of children is simply too important to be linked to other issues in our bilateral relationship," U.S. Ambassador Michael McFaul said in a statement.

The bill is a dramatic demonstration of two strains of animosity toward the United States. The Russian political establishment resents the United States for allegedly meddling in the country's internal affairs; Putin has charged that opposition protests over the past year were the work of U.S.-funded troublemakers. Many Russians are angered by cases of adopted children abused in America and by the alleged lenience of courts in these cases.

The Duma bill is named in honor of Dima Yakovlev, a Russian toddler who was adopted by Americans and then died in 2008 after his father left him in a car in broiling heat for hours. The father was found not guilty of involuntary manslaughter.

Anger over abuse peaked in 2010 when an American woman sent her 7-year-old adopted Russian son back to Moscow on a plane alone, saying he had emotional problems and she could no longer care for him.

Despite abuse cases, Russian critics of the bill say it would ultimately victimize orphans by depriving them of an opportunity to escape often-dismal Russian orphanages. There are about 740,000 children without parental custody in Russia, according to UNICEF. Russians historically have been less inclined to adopt children than in many other cultures.

More than 60,000 Russian children have been adopted in the United States in the past 20 years, McFaul said.

But Russia's children's ombudsman Pavel Astakhov, one of the strongest critics of U.S. abuse cases, says the solution is for Russia to adopt a national program to improve orphans' prospects.

"It's necessary to strictly hold to the principle of priority for Russian adopters," he told Interfax after the Duma vote.

It changes all the time. My least favourite pose when I started (because it was so hard) is now one of my favourite poses (because now I can do it and it has taught me that things that seem impossible can be achieved by regular practice), the pose is called tiriangmukiekapadapascimottanasana

So many to choose from! I love jumping from downward dog into bhuja pidasana, I love ghaba pindasana, I love ekabhuja urdva padmasana, I love baddha padmasana, I love janu sirsasana C. I love uthita hasta padangustasana.

I do Mysore style ashtanga vinyasa yoga meditation. I've tried a few other kinds and they don't really do it for me. Only ashtanga gets me into the zone in the way that a few hours dancing or 23 dried welsh liberty caps do.

'vinyasa' means 'movement-breathing-system'. If there is a specific sequence (krama) and every movement happens on a specific breath, then it is vinyasa yoga. Ashtanga yoga is vinyasa yoga. Most classes calling themselves vinyasa classes are not true vinyasa because the instructor does not care (and never will) whether or not you really are inhaling or exhaling when you should be. You're right about Hatha - it means 'forcing meditation', the principle being that you can force just about anyone into a state of meditation with the right kind of moving and breathing whereas not everyone can be brought to meditation via more intellectual means (actually, no-one ever thought their way into meditation!)

Very true about the vinyasa yoga. That's why I stay away from the very fast paced sets, because ujjayi goes out the window. Smile I don't believe that the purpose of raising your kundalini is to induce psychosis though. It's more about raising your consciousness to the present, and putting yourself into a meditative state. I find it easier to delve into it with the mixture of repetition, willpower, and mantra.

I can assure you that the experience of psychosis and kundalini rising are one and the same, but the prognosis depends on what prior training and preparation you've had.

I do "bicycle guitaring" yoga, but when I started doing it back in the early 1980s I did not at that time realize I was doing yoga. I just did it. For me, it is a meditation in motion.

Near as I can figure, this is both an action yoga (because of the movement) and a sound yoga (because there is music involved). There may be other forms of yoga involved. I am not familiar with all the formal names of the specific yoga types.
